Rules and Regulations
- To be an eligible entrant, you must be at least 21 years old.
- No employee of Suffolk Downs or any affiliated agency is eligible to participate.
- No family member of an employee of Suffolk Downs or any affiliated agency is eligible to participate.
Suffolk Downs may collect personal identifiable information from entrants when they enter or win the promotion.
- The prize will be awarded to a person selected by Suffolk Downs.
- The prize is not transferable or convertible and must be accepted as awarded unless otherwise provided by Suffolk Downs in writing.
- Suffolk Downs accepts no responsibility for stolen, lost or misdirected entries or prizes.
- All winners will be notified directly by Suffolk Downs.
- To be confirmed as a winner, you may be asked to sign a declaration and release form that confirms compliance with these Rules and Regulations.
- Failure to comply with these Rules and Regulations, as applicable, may result in forfeiture of the prize.
- Any entry, once submitted to Suffolk Downs becomes the exclusive property of Suffolk Downs (or the sponsor, as the case may be) and will not be acknowledged or returned.
- Upon submission, the entrant agrees to release all rights, title and interest in and to its entry.
- Except where prohibited, participation in the promotion constitutes the winner’s consent to Suffolk Downs’ use of the winner’s name, likeness, voice, opinions, hometown, state/province and country for promotional purposes in any media without further payment or consideration.
- The winner’s photo and quote may be used in promotions for future promotions and other Suffolk Downs’ events.
- Suffolk Downs’ is not obligated to use any entrant’s entry for commercial or other purposes.
- The winner is solely responsible for all applicable taxes on the value of the prize.
- Suffolk Downs and its affiliates accept no liability or responsibility in connection with injuries, loss or damage of any kind arising out of this promotion or prize.
- By accepting any promotional prize, the winner agrees that Suffolk Downs, its respective parents, subsidiaries and affiliated companies, and the agents, employees, directors and officers of these companies (collectively, the “Released Parties”), are not liable whatsoever for any injuries, losses or damages of any kind resulting in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of any prize or from winner’s participation in the promotion.
- The Released Parties are not responsible for: (a) incorrect or inaccurate entry information, all of which will be disqualified; (b) unauthorized human intervention in any part of the entry process or the promotion; (c) electronic or human error which may occur in the administration of the promotion or the processing of entries.
- Suffolk Downs provides all information related to this promotion “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.
- Suffolk Downs reserves the right, in its sole discretion, to disqualify any individual if it finds to be tampering with the entry process or the operation of the promotion or to be acting in violation of these Rules and Regulations or in an unsportsmanlike or disruptive manner.
- Any attempt by any person to deliberately damage or undermine the legitimate operation of this promotion may be a violation of criminal and civil laws, and, should such an attempt be made, Suffolk Downs reserves the right to seek damages from any such person to the fullest extent permitted by law.
- As a condition of entering the promotion, entrant agrees that: (a) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of or connected with this promotion, or the prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees.
- This promotion is subject to all Federal, State and Municipal laws and regulations.
- This promotion is void if prohibited and/or restricted by law.
- Any decisions made by Suffolk Downs regarding the promotion are in its sole discretion and are final.
- Suffolk Downs reserves the right, in its sole discretion, to cancel, modify or suspend the promotion at any time without prior notice.
- Suffolk Downs’ failure to enforce any term of these Rules and Regulations shall not constitute a waiver of that provision.
- If any provision of these Rules and Regulations or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, then such provision shall be deemed to be replaced by the valid and enforceable provision most substantively similar to such invalid or unenforceable provision, and the remainder of these Rules and Regulations and the application of such provision to persons or circumstances other than those as to which it is invalid or unenforceable shall not be affected thereby.
